Chat with extra Rules
These Rules apply to every person posting or reading comments made on the Chat with extra area of the Family Fund Extra website, the home page of which is at www.familyfundextra.org.uk.
Each time you wish to post comments on Chat with extra you will be required to log in by providing your username and password. By logging in you are indicating your continued acceptance to be bound by these Rules.
Your Responsibilities
You agree:
- to keep your user name and password secure at all times and to contact us by emailing extra customer or telephoning 0844 247 3424 immediately if you have reason to believe that they may no longer be secure;
- not to use any other user's identity to log on to Chat with extra or the Family Fund Extra website or to impersonate any person or to assume a false identity;
- to accept full responsibility for any messages you place on Chat with extra;
- only to use Chat with extra for lawful purposes;
- not to post harassing, inaccurate, defamatory, abusive, offensive, pornographic, racist, sexist, threatening, vulgar, obscene, hateful or otherwise inappropriate comments, or to post comments which will constitute a criminal offence or give rise to civil liability or may cause offence in relation to sexual orientation, age, marital status, disability or working status, on Chat with extra;
- not to post personal information about yourself or any third party on Chat with extra;
- not to post, or to accept medical advice posted, on Chat with extra;
- not to use Chat with extra to advertise or offer for sale any goods or services for any commercial purpose, make any requests for money, or to promote any surveys, contests or chain letters without the express written permission of Family Fund extra;
- not to post or make available any material which is protected by copyright, trade mark, confidentiality or other proprietary right on Chat with wxtra without the express permission of the owner of the copyright, trade mark or any other proprietary right and you will be solely liable for any damages resulting from any infringement of the same;
- not to upload to Chat with extra files which contain viruses, or files or programs that are designed or intended to disrupt, damage or limit the functioning of any software, hardware or telecommunications equipment or to damage or obtain unauthorised access to any data or other information of any third party, and you will be solely responsible for any damages in relation to any claims that may arise because you posted files that caused damage to the operation of our or another person's software, hardware or telecommunications equipment; and
- to evaluate for yourself the accuracy, completeness or usefulness of any opinion, advice or other content in Chat with extra.
Complaints
If you wish to complain about anything posted on Chat with extra please use our Contact us form or email at extracustomer@familyfund.org.uk or write to Chat with extra Quality Assurance Manager at Family Fund extra, 4 Alpha Court, Monks Cross Drive, Monks Cross, Huntington, York, North Yorkshire, YO32 9WN, including details of your complaint, what action you would like us to take and how we can contact you. Please note that we will deal with the matter, as we deem appropriate, but that we will take note of your views. We will investigate your complaint and endeavour to contact you within two working days of receiving your email, or letter. If you have not heard from us within that time, please call 0844 247 3424 and ask for the Chat with extra Quality Assurance Manager.
Monitoring
When users submit comments on Chat with extra they are sent automatically to a holding area which is not accessible via the Family Fund extra website. We will review each comment before is released for posting and may (but are not obliged to) monitor the live contents of Chat with extra and edit or remove any comments which we deem to be inappropriate without giving reason or notice.
By releasing a comment for posting on Chat with extra Family Fund Extra is not making or endorsing the comment.We may temporarily or permanently deny any user’s access to Chat with extra without giving you reasons or notice.We may refer any matter to a law enforcement agency or Court of competent jurisdiction where we consider a matter is potentially of a criminal or unlawful nature.
Your Identity and Licence
You acknowledge that comments posted on Chat with extra are not private communications and can be viewed by everybody who visits Chat with extra, that other users will be able to identify who has posted each comment.
You must log off Chat with extra when you have finished posting comments to prevent anyone else accessing Chat with extra using your log-on identity. This is particularly important where other people may use the same computer as you, such as in internet cafes. If you do not log off, you may be deemed to be the person viewing or posting comments unless you can prove otherwise.
We reserve the right to reveal your identity and contact details to third parties if we believe that you may have breached any of these Rules.
For your own safety and security, we recommend that you do not disclose personal information such as your password, credit card number, home address, email address or phone number on Chat with extra.
By posting comments on Chat with extra, you grant us and all other users the right to obtain access to your comments, to view, store and reproduce your comments and to enforce these Rules against you if you breach them.
Limitation of Liability and Exclusion of Warranties
You acknowledge that the author of each posting on Chat with extra is responsible for his or her comments.
Insofar as the law permits, we shall not be liable for any loss, damage or distress incurred as a result of comments made on Chat with extra.
We are not responsible for the accuracy, veracity or reliability of any opinion, advice, statement or comment made on Chat with extra and such communications shall not be considered to be screened, monitored, edited or approved by us regardless of the fact that the comments were released by us before they were posted on the accessible area of Chat with extra.
Indemnity
You acknowledge that you are responsible for any comments that you post on Chat with extra and that if you breach any of these Rules you may be personally liable to any third party that suffers harm as a result.
You agree to indemnify and keep indemnified us, our successors and assigns, our directors, trustees, offices, employees and agents from and against all liabilities, claims, losses, costs, damages and expenses including legal fees which are reasonably incurred by us arising in connection with your breach any of these Rules.
The indemnity set out in clause 6.2 includes your use of the information you have obtained from Chat with extra, together with any introduction or collaboration that you enter into as a result of participating in Chat with extra.
General
We reserve the right to modify these Rules at any time without notice. You are bound by any changes made to these Rules with effect from the date of the change. If we make any substantial changes to these Rules we will notify you by posting a notice on the home page of this website. The current version of these Rules can be accessed by clicking on the “Chat with extra Rules” button on the home page of Chat with extra area of the Family Fund Extra website.
The Rules shall be governed by and interpreted in accordance with English law.
The English Courts shall have jurisdiction to hear disputes between us.
